Welcome to Elm Computing. These Terms of Service ('Terms') govern your use of our cloud computing solutions and services. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the services.

Service Description: Elm Computing provides pre-configured cloud images, deployment services, and technical support across AWS, Microsoft Azure, Google Cloud Platform, and Alibaba Cloud to help researchers, data scientists, and developers deploy enterprise-grade solutions quickly and securely.

As a user, you agree to provide accurate information, follow applicable laws, avoid illegal or harmful use, respect intellectual property rights, protect your infrastructure and credentials, and comply with the terms of the underlying cloud platforms.

Service Availability: We aim for reliability, but service may be temporarily unavailable for maintenance, technical issues, third-party cloud disruptions, or events beyond our control.

Intellectual Property: Our content, software, documentation, and materials are protected. Elm Computing retains rights to proprietary software and configurations; you may not copy, modify, or distribute them without permission. Third-party software follows its own licenses. You own your data and applications, and you grant us limited access to provide support.

Limitation of Liability: To the maximum extent permitted by law, Elm Computing is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, downtime, third-party or cloud issues, or security breaches and data loss.

Indemnification: You agree to indemnify and hold harmless Elm Computing, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination: Either party may end use at any time. We may suspend or terminate access immediately for violations of these Terms or our Privacy Policy, fraudulent or illegal activity, non-payment, or security risks.

Upon termination, your right to use our services ceases immediately. We are not obligated to provide any refunds or compensation for terminated services.

Governing Law and Dispute Resolution: These Terms are governed by applicable laws. Disputes will be addressed through good-faith negotiation, then binding arbitration if needed, or the appropriate courts if arbitration is unavailable, and you waive any right to participate in class action lawsuits or class-wide arbitration against us.

Changes to Terms: We may modify these Terms at any time. When we make material changes, we will post the updates, refresh the 'Last Modified' date, and notify users by email if explicitly requested. Continuing to use the services after changes are posted means you accept the updated Terms; if you do not agree, you must stop using the services.
